The rules and responsibilities that keep NIXIFY safe and fair for everyone.
User Responsibilities
As a customer using NIXIFY, you agree to the following responsibilities:
- Provide accurate and complete information about items to be picked up, including weight, dimensions, and any special handling requirements.
- Ensure items are accessible at the scheduled pickup time and location.
- Be available to communicate with your assigned driver during active pickups.
- Pay for services promptly through the platform. Cash payments outside the app are prohibited.
- Treat all drivers with respect and professionalism.
- Report any damage, disputes, or issues through the app within 24 hours of job completion.
Driver Responsibilities
As a driver on NIXIFY, you are an independent contractor, not an employee of NIXIFY. You agree to:
- Maintain a valid driver license, vehicle registration, and any required insurance for your vehicle type.
- Ensure your vehicle is clean, safe, and appropriate for the jobs you accept.
- Arrive at pickup locations within the agreed timeframe and communicate any delays.
- Handle customer items with reasonable care during transport.
- Dispose of items only at authorized facilities. Illegal dumping is strictly prohibited and will result in permanent account termination.
- Maintain professional conduct with all customers.
- Keep your payout and tax information current and accurate.
Prohibited Items
The following items are strictly prohibited from being transported through NIXIFY:
- Hazardous materials, chemicals, explosives, or flammable substances.
- Illegal goods, stolen property, or items obtained through fraud.
- Firearms, ammunition, or weapons of any kind.
- Live animals or perishable goods requiring refrigeration (unless explicitly agreed).
- Human remains or biological waste.
- Items that exceed the weight or size capacity of the assigned vehicle type.
Drivers have the right to refuse pickup of any item they believe falls into a prohibited category. If you are unsure whether an item is allowed, contact support before posting a job.
Payment & Payout Terms
NIXIFY uses Stripe to process all payments securely. By using the platform, you agree to the following payment terms:
- Customers: Payment is collected upfront when a job is created and held securely until the job is marked complete.
- Drivers: Earnings are transferred to your connected payout method after job completion, subject to Stripe processing times.
- Fees: NIXIFY retains a platform service fee from each transaction. The fee percentage is disclosed at checkout and in your driver earnings dashboard.
- Taxes: Drivers are responsible for reporting their earnings and paying applicable taxes. NIXIFY will provide tax documentation where required by law.
- Failed or disputed payments may result in delayed payouts or account holds until the issue is resolved.
Cancellation Policy
We understand plans change. Our cancellation policy is designed to be fair to both customers and drivers:
- Before a driver accepts: Full refund, no cancellation fee.
- After a driver accepts but before pickup begins: 10% cancellation fee to compensate the driver for reserved time.
- After pickup has started: A minimum $25 fee or 25% of the job total (whichever is greater) applies, as the driver has already committed time and resources.
- No-shows: If the customer is unavailable at the pickup location after reasonable attempts to contact them, the driver may mark the job as a no-show and the customer may be charged the full amount.
To cancel a job, use the in-app cancellation feature. Refunds are processed to the original payment method within 5-10 business days.
Marketplace & Liability Disclaimer
NIXIFY is a technology marketplace that connects independent customers with independent drivers. We do not directly provide hauling or transportation services.
- NIXIFY is not liable for damage to items during transport, though we encourage drivers to exercise reasonable care and customers to purchase appropriate insurance for high-value items.
- We do not guarantee the availability of drivers in any specific area or timeframe.
- We do not endorse, certify, or guarantee the quality of any driver on the platform. Ratings and reviews are provided by other users and should be used at your discretion.
- NIXIFY's total liability for any claim arising from your use of the platform is limited to the amount you paid for the specific job giving rise to the claim.
Independent Contractor Relationship
Drivers on the NIXIFY platform are independent contractors, not employees, agents, or partners of NIXIFY.
- Drivers set their own schedules and choose which jobs to accept.
- Drivers are responsible for their own equipment, fuel, maintenance, and vehicle expenses.
- Drivers are responsible for their own taxes, insurance, and compliance with all applicable laws and regulations.
- NIXIFY does not withhold taxes, provide benefits, or guarantee minimum earnings.
- Nothing in these Terms creates an employment, partnership, or joint venture relationship between NIXIFY and any driver.
Account Suspension & Termination
NIXIFY reserves the right to suspend or terminate any account that violates these Terms or threatens the safety and integrity of our community.
- Violations include: illegal dumping, fraud, harassment, providing false information, repeated cancellations, payment disputes, and transporting prohibited items.
- We may suspend accounts temporarily while investigating reports of misconduct.
- Termination may be immediate for serious violations including illegal activity.
- Users may appeal suspension decisions by contacting support. NIXIFY reserves final discretion on all appeals.
- Upon termination, any pending payouts will be processed according to our standard payout schedule, minus any outstanding fees or dispute holds.
Dispute Resolution
We encourage users to resolve disputes directly through our in-app support. For issues that cannot be resolved informally:
- Both parties agree to first attempt mediation through NIXIFY support before pursuing legal action.
- If mediation fails, disputes will be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.
- Class action waivers apply: both parties agree to resolve disputes only on an individual basis, not as part of a class action.
- Nothing in this section prevents either party from seeking injunctive relief in court for intellectual property or unauthorized use claims.
For drivers in jurisdictions where arbitration agreements are not enforceable for independent contractor disputes, alternative dispute resolution will follow applicable local law.

These Terms of Service were last updated on January 1, 1970. We may modify these Terms at any time. Material changes will be communicated via email or in-app notification. Continued use of NIXIFY after changes constitutes acceptance of the updated Terms.
